What can an unlicensed helper legally do on HVAC and plumbing jobs?

The employer's compliance picture: what a helper may do under your licence, where registration is required, how EPA 608 reaches the newest hire, and what a solo violation costs.

In every state rule we verified, an unlicensed helper can work on an HVAC or plumbing job only under a licensed supervisor's authority โ€” the scope of what they may touch is set state by state, down to whether the helper must register first.

Refrigerant is the federal layer on top of the state rules: opening a refrigerant circuit takes EPA 608 certification, or the rule's close-supervision apprentice exemption.

A helper working alone is where the penalties start.

What work can an unlicensed helper do under supervision?

Every rule we verified draws the same line: an unlicensed helper works as an extension of a licensed person or business, never in their own name.

In Delaware, only a licensed master plumber may provide plumbing services, and apprentices and journeymen may work unlicensed under the supervision of a master plumber who employs them or works full time for the same business.

The state's HVACR rule mirrors it โ€” a Delaware HVAC business must have a Master HVACR (or restricted) licensee supervising its workers, and unlicensed employees may only do HVACR work under a master who is their employer or works full time for the same business.

New Jersey sets the rule through employment status: HVACR work that a master HVACR contractor has not subcontracted may be done only by the master or by W-2 employees of the master or the HVACR business, so unlicensed technicians can work legally as W-2 employees of a licensed business.

New Jersey then tiers the supervision.

An unlicensed HVACR worker with less than two years of experience needs constant on-site supervision by a master HVACR contractor or an HVACR journeyperson with at least five years of experience; preventive-maintenance workers with one year or more need only daily contact.

Status and geography narrow the permission further.

Kentucky exempts unlicensed employees who work under a master HVAC contractor, are not journeymen or apprentices, and do not contract on their own from Kentucky's HVAC licensing law.

Montana exempts apprentices, as the state defines them, working under the supervision of a licensed plumber from plumbing licensure.

In Indianapolis, an unlicensed worker employed by a licensed heating and cooling contractor may do heating and cooling work under that contractor's direction and control, limited to the scope of the contractor's licence type โ€” but may not contract on their own.

Registered-apprentice status comes with its own supervision definitions.

A Texas Plumber's Apprentice may do plumbing only under direct supervision, which Texas defines as a TSBPE licensee on the job site at all times.

Minnesota allows plumbing work only by DLI-licensed plumbers, DLI-registered unlicensed plumbers, or people enrolled in a DLI-registered apprenticeship โ€” and unlicensed workers must be directly supervised at all times by a licensed journeyworker or master.

The HVAC side has a structural wrinkle: only about a quarter of jurisdictions (13, counting DC) license HVAC workers at an apprentice/technician/journeyman rung at all โ€” the rest license contractors only, license the master level only, split HVAC into fuel-gas, refrigeration and electrical pieces, or leave licensing to cities.

Where no worker rung exists, "helper" is not a status the state tracks โ€” what governs is whichever of those regimes applies: the contractor licence, a master-level credential, a split fuel-gas, refrigeration or electrical credential, or the city's own rule.

Check the jurisdiction before you assume.

Texas is the counterexample: anyone who assists a licensed air conditioning and refrigeration (ACR) contractor with maintenance or repair work must hold at least a TDLR technician registration โ€” a statewide requirement.

Which states require helpers or apprentices to register?

Louisiana licenses plumbers statewide through the State Plumbing Board of Louisiana (SPBLA), and every unlicensed person doing plumbing or gas fitting must register as an apprentice, work for a master company and be supervised by a journeyman or master.

Alabama requires apprentice plumbers and gas fitters to register with the Alabama Plumbers and Gas Fitters Examining Board (PGFB), carry a current annual certificate, and work under the direct supervision of a journeyman or master.

Texas makes the registration inexpensive and the timing strict.

A Texas Plumber's Apprentice registration requires age 16 or older, costs $15 and renews for $15 a year โ€” and plumbing hours count toward the Tradesman or Journeyman exam only after the worker is registered with the Texas State Board of Plumbing Examiners (TSBPE).

An unregistered helper is not just missing a credential; their hours are not accruing toward a licence.

Minnesota's entry credential is the registered unlicensed plumber (formerly "apprentice"): no experience needed, a $14 fee, renewed every June 30 with 2 hours of code CE โ€” and the holder must be a W-2 employee of a licensed plumbing contractor or registered plumbing employer.

Washington requires plumber trainees to be at least 16, hold a trainee certificate ($60, valid 12 months), work under the direct supervision of a certified plumber, and take 8 hours of approved CE yearly to renew.

On the piping side, Minnesota's high-pressure piping rule says unlicensed helpers may assist only if they are registered with DLI or in an approved apprenticeship, working under a licensed pipefitter.

West Virginia covers both trades with certifications: HVAC apprentices and helpers must hold a Technician in Training certification, and plumbing helpers a Plumber in Training certification โ€” and neither can work alone.

Can a helper handle refrigerant without EPA 608?

Refrigerant handling has its own federal layer.

Under EPA's Section 608 rule (40 CFR 82.161), any person who could reasonably be expected to violate the integrity of the refrigerant circuit while maintaining, servicing, repairing or disposing of appliances containing CFC/HCFC or non-exempt substitute refrigerants โ€” HFCs included โ€” must pass an exam from an EPA-approved technician certification program.

The person who opens that circuit is who the rule reaches.

For apprentices, the certification requirement has a supervision-based exemption.

Apprentices are exempt from 608 certification only while they are closely and continually supervised by a certified technician, and the supervising technician and the apprentice share responsibility for compliance.

The rule sets no time limit on the exemption โ€” but it holds only while the close, continual supervision does.

The sales restriction is the employer-side piece.

Only EPA-certified technicians โ€” Section 608 for stationary refrigerant, Section 609 for motor-vehicle A/C โ€” may buy ozone-depleting or substitute refrigerants such as HFCs, with limited exceptions; an employer may buy if it gives the wholesaler written evidence that it employs at least one certified technician.

Verifying a card is a program-by-program check: EPA does not issue 608 certification cards, the certifying organizations do, and there is no EPA-run national lookup โ€” since January 1, 2018, each non-federal certifying program must publish an online list of the technicians it certified on or after January 1, 2017; technicians may opt out of those lists.

Enforcement is priced federally: under EPA's inflation-adjustment table, for penalties assessed on or after January 8, 2025, the maximum civil penalty under Clean Air Act ยง113(b) is up to $124,426 per violation.

And the A2L transition does not change the certification picture: there is no federal A2L certification, and EPA says technicians already certified under Section 608 or 609 do not need to be re-certified.

Section 608 certification does not expire.

EPA's SNAP use conditions for the A2L substitutes listed for new residential and light-commercial AC and heat pumps do say personnel who commission, maintain, repair, decommission or dispose of these appliances should obtain training and follow practices consistent with Annex HH of UL 60335-2-40 โ€” a recommendation, not a federal certification requirement; state or local mechanical codes may add their own, so confirm with your code official.

What happens if an unlicensed worker is caught working alone?

Some supervision rules are written as physical presence, and a solo worker breaks those outright.

West Virginia's Technician in Training and Plumber in Training holders cannot work alone.

In Clark County, Nevada, journeyman plumbers may supervise any number of workers but must remain on site while unlicensed or uncertified workers are working.

Texas defines direct supervision as a licensee on the job site at all times โ€” the moment your licensee drives to the next call, the apprentice is performing plumbing outside the only condition Texas allows.

In Delaware, the exception that lets apprentices and journeymen work unlicensed runs through supervision by a master plumber of the same business โ€” outside it, unlicensed plumbing carries a fine of $1,500 to $3,000 for a first offense and $3,000 to $6,000 for later offenses.

In Vermont, a specialty plumbing business may hire or employ only people licensed in that specialty, and employing unlicensed workers for plumbing carries fines up to $1,000 per offence โ€” the business is the named target.

Unlicensed contracting is a separate violation with its own penalties: Nevada treats unlicensed contracting as a misdemeanor on a first offense, with a fine of up to $1,000 and up to 6 months in jail, rising to a category E felony by the third offense.

Notice who is exposed: Vermont's rule names the business that employs unlicensed workers, and a refrigerant violation carries its own federal exposure โ€” up to $124,426 per violation under EPA's inflation-adjustment table for penalties assessed on or after January 8, 2025.

The structural fix: register the helper where your state requires it, keep the required supervisor physically present, and get the helper certified so the exemption stops mattering.

Can an unlicensed person do plumbing work under supervision?

Can an apprentice buy refrigerant without EPA 608?

No. Only EPA-certified technicians may buy ozone-depleting or substitute refrigerants such as HFCs, with limited exceptions โ€” an employer may buy by giving the wholesaler written evidence that it employs at least one certified technician.

What is the fine for unlicensed plumbing work?
